Acquisition Of Properties
The acquisition of property in India by individuals residing outside the country is governed by certain regulations. Indian citizens residing abroad can acquire any immovable property in India, except for agricultural, plantation, or farmhouse properties. For individuals of Indian origin, the definition is more specific, excluding citizens of certain countries. Transfer of property is also regulated, allowing residents outside India to transfer immovable property to Indian citizens or persons of Indian origin, while agricultural land and farmhouses can only be transferred to Indian citizens residing in India. Property acquisition can be done through purchase, gift, or inheritance, in compliance with the foreign exchange laws. Additionally, non-residents with approved business activities in India can acquire property necessary for their operations.
